What Is The Process For Claiming Sexual Abuse Through The CICA?

Often, the process for claiming sexual abuse through the CICA starts with proving that the crime was reported to the police. Also, claiming within the time limit is an important consideration. Normally, the CICA applies a 2-year deadline in which to launch a compensation claim. This period commences from the date of the incident.

The CICA provides a multiple injury formula which allows the claimant to seek compensation for up to 3 injuries. This is calculated by taking the stated figure for the injury in question and awarding as follows:

  • 100% of the figure for the highest-valued injury.
  • 30% of the tariff amount for the second-highest (or equal).
  • 15% of the total normally awarded for the third injury, if it is either equal to the second injury or the third highest value.

Additionally, compensation can be awarded through a tariff that is not calculated using this formula for cases where you contracted a sexually transmitted infection, became pregnant, or lost a fetus as a result of a crime of violence.
