As you can see from the graph above, the most commonly recorded category of sexual offence was indecent exposure or sexual touching without consent, which 1.6% of 16 to 74 year olds reported having experienced once or more. Of these two offences, unwanted sexual touching was more common, with 1.4% of respondents saying that they had experienced this.

How Can You Seek Sexual Assault Compensation?

There are three avenues through which you may be able to use to claim criminal injury compensation. You may be able to claim against the perpetrator directly if you know their identity and they have the financial assets to compensate you. Alternatively, it may be possible to claim against a vicariously liable third party if they breached the duty of care they owed you, resulting in sexual assault.

If neither of these options is available to you, then you may be able to claim through the Criminal Injuries Compensation Authority (CICA). This is a government-sponsored executive agency established to provide a means for the victims of crime to receive compensation.

When claiming through the CICA, you must meet certain eligibility requirements. First, the incident must have occurred in England, Scotland, Wales or another relevant location. Second, your injuries must have occurred in a crime of violence as defined by the CICA. This definition includes sexual assault.

Third, the incident must have been reported to the police. This must be done as soon as possible; this is usually expected to be right after the incident occurs, though there may be extenuating circumstances that mean you cannot report it immediately. Your claim may still be considered if this is the case.

Potential Evidence When Claiming Through The CICA

To claim through the CICA, you may be asked to provide supporting evidence, such as:

When this rule was removed in 2019, the time limit for claiming was extended until June 2021 for people who previously would not have been able to claim because of this rule. Claimants who were prevented from submitting this case by the deadline because of exceptional circumstances may still have their claims considered.

Special Expenses In CICA Compensation Payouts
